1. Introduction and acceptance of terms

Welcome to the BETA Company website. By using our website or contacting us to request quotes or engage in any of our industrial services, you agree to be bound by these terms and conditions. If you do not agree to any part of these terms, please do not use the website or submit any requests through it.

2. Scope of Services

BETA provides industrial services and solutions in the manufacturing of metal structures, sheet metal forming, cable tray and ladder systems, chute and ventilation system components, and other custom metal products for industrial and construction projects. The scope of services, technical specifications, and quantities are defined precisely in quotations, purchase orders, and contracts signed with the client. In the event of any discrepancy, the terms stated in the contract or purchase order shall be considered the primary reference.

3. Offers, Orders, and Confirmation

Price quotations issued by the company are valid for a limited period as stated in the offer, and prices may change after the quotation expires or if specifications or quantities are modified. No order shall be considered finally accepted unless it is confirmed in writing by BETA (such as email confirmation, signed quotation, or a mutually accepted purchase order). The company reserves the right to reject any order or request modifications if the provided information is incomplete, unclear, or does not comply with technical standards and safety requirements.

4. Pricing, Payment Methods, and Taxes

Prices are calculated based on raw materials, specifications, required loads, quantities, and market conditions at the time of the offer. Unless otherwise stated, prices do not include any taxes, customs duties, or additional fees imposed by other authorities, which shall be borne by the client according to applicable regulations. Payment terms (such as advance payment, progress payments, final payment) are agreed upon in the quotation or contract. The company may suspend or delay production or delivery in case of late payment, with the possibility of charging late fees or holding orders until outstanding amounts are settled.

5. Production, Delivery, and Estimated Timelines

Production and delivery schedules are considered estimated timelines, depending on the availability of raw materials, production capacity, and timely receipt of data and approvals from the client. BETA makes every effort to adhere to the agreed timelines; however, it is not responsible for delays caused by factors beyond its control, such as force majeure, supply chain issues, or delays in client approvals or drawings. Delivery terms (e.g., factory delivery, delivery to a specified site, or other commercial terms) are specified in the quotation or contract and determine when responsibility and risk for the goods transfer from the company to the client.

6. Technical Responsibilities and Client Information

The client is responsible for providing the company with accurate drawings, complete technical data, and precise information regarding loads and site conditions. The company may review the information and provide technical comments, but the final responsibility for compliance with the overall project design, local regulations, and installation conditions rests with the client and their consultants. Any changes to specifications, drawings, or quantities after order confirmation may result in adjustments to prices and delivery schedules and require written approval from both parties.

7. Website Use and Intellectual Property Rights

All content available on the Website, including but not limited to texts, images, graphics, logos, product descriptions, and designs, is owned by BETA or used with permission from the respective rights holders, and is protected under applicable intellectual property laws. You are permitted to use the Website and review its content solely for informational purposes or for business purposes within your company. You may not copy, reproduce, republish, distribute, or modify any content without obtaining prior written consent from the Company. Any use of the Website that may result in its disruption, hacking, or unauthorized access to any part of its systems is strictly prohibited.

8. Limitation of Liability and Governing Law

To the extent permitted by applicable law, BETA’s liability for any claim arising out of the use of the Website or the supply of products or services shall be limited to the value of the products or services supplied under the order that is the subject of the dispute. The Company shall not be liable for any indirect or consequential damages, including loss of profits, delay damages, or penalties, unless otherwise expressly agreed in a written contract. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia, and the courts of the city of [e.g., Riyadh] shall have exclusive jurisdiction over any dispute arising therefrom, unless otherwise agreed in writing on an alternative competent jurisdiction.
